Abstract

This article examines the protection of a person’s psychological integrity in criminal proceedings and the distinction between the lawful consequences of procedural coercion and unlawful psychological pressure. The study is based on a formal legal, systematic, and functional analysis of normative legal sources. The Constitution, the Criminal Code, the Criminal Procedure Code, explanatory resolutions of the Plenum of the Supreme Court, and international instruments are compared. The findings substantiate the need to clarify the criteria for identifying and documenting psychological pressure, without disregarding existing prohibitions and mechanisms for declaring evidence inadmissible. Assessment criteria encompassing legality, procedural purpose, freedom of will, and the possibility of verification are proposed. Areas for improving practical procedures that link the recording of complaints, preservation of information, and independent investigation are identified.
