COERCION IN THE TERMINATION OF AN EMPLOYMENT CONTRACT AT THE EMPLOYEE’S INITIATIVE AND THE CHALLENGES OF PROVING SUCH CASES

The article examines cases where employees are coerced into submitting "voluntary" resignation letters, based on Article 161 of the Labour Code of Uzbekistan and Supreme Court Plenum Resolution No. 26 of 20 November 2023. It classifies forms of coercion and identifies problems of proving it in court. Drawing on the experience of the United Kingdom, Germany and Russia, it proposes a shifted burden of proof, a ban on undated resignation letters and the introduction of constructive dismissal.
