Mazkur maqolada ipoteka shartnomasiga oid nizolarni fuqarolik
va iqtisodiy sudlarda ko‗rib chiqish jarayonida isbotlash institutining tutgan o‗rni va
ahamiyati huquqiy-nazariy hamda amaliy jihatdan tahlil qilinadi. Xususan, isbotlash
jarayonining huquqiy asoslari, isbotlash majburiyatining taqsimlanishi, dalillarning turlari,
ularni sudga taqdim etish va baholash tartibi keng yoritiladi. Ipoteka bilan bog‗liq ishlar
bo‗yicha yozma dalillarning ishonchliligi, notarial tartibdagi hujjatlarning protsessual kuchi,
shuningdek, bank va moliyaviy hujjatlarning isbot vositasi sifatidagi maqomi chuqur tahlil
qilinadi.
