The thesis examines the allocation of the burden of proof in labour disputes involving forced resignation. The provisions of Resolution No. 26 of the Plenum of the Supreme Court of the Republic of Uzbekistan of 20 November 2023 are compared with the approaches of Russia, Germany and the United Kingdom, ILO Convention No. 158 and EU Directive 2006/54/EC. Based on this analysis, a two-stage mixed model is proposed for Uzbekistan: once the employee presents indirect indications of coercion, the burden of proving that the resignation was voluntary shifts to the employer. An amendment to Article 161 of the Labour Code and safeguards against abuse are substantiated.
